Acting Services Terms & Conditions

These Terms and Conditions apply when you purchase a Drama School Audition Programme or Acting Coaching Session from Speaking Voices Ltd.

1. Definitions

1.1 In these Terms and Conditions, the following definitions apply:

1.2 “Speaking Voices”, “we”, “us” or “our” refers to Speaking Voices Ltd, a company incorporated in England and Wales under company number 16969380, whose registered office is at 44–45 Beaufort Court, Admirals Way, London, E14 9XL.

1.3 “Client”, “you” or “your” refers to the person purchasing the Services.

1.4 “Session(s)” means the Client receiving the acting or drama school audition coaching.

1.5 “Programme” means the package of Sessions purchased by the Client.

1.6 “Acting Coach” means the coach assigned by Speaking Voices to provide the Services.

2. General

2.1 By purchasing a Session or Programme from Speaking Voices, the Client agrees to be bound by these Terms and Conditions.

2.2 Where the Client is under the age of 18, these Terms and Conditions must be accepted by the Client's parent or legal guardian on the Client's behalf. The parent or legal guardian is responsible for ensuring that the Client complies with these Terms and Conditions.

2.3 These Terms and Conditions form the agreement between Speaking Voices and the Client in relation to the Services.

2.4 If any part of these conditions is held to be illegal, invalid or unenforceable in any respect such invalidity or illegality shall not prejudice the effect of the rest of these conditions to the extent that they are valid, legal and enforceable.

3. Services

3.1 Speaking Voices provides 1:1 acting coaching and drama school audition preparation delivered by an Acting Coach assigned by Speaking Voices.

3.2 The Services may include, depending on the Session or Programme purchased:

  • Drama school audition preparation
  • Monologue selection, preparation and coaching
  • Script and character analysis
  • Audition technique
  • Performance preparation
  • Self-tape preparation
  • Breath, voice and physical preparation
  • Audition confidence
  • Audition question preparation
  • Guidance around audition requirements and processes
  • Constructive feedback on performance
  • Preparation for recalls, where appropriate
  • Other related acting and audition coaching agreed between the Client and the Acting Coach.

3.3 Sessions will primarily be delivered online via Zoom unless otherwise agreed in writing with the Acting Coach.

3.4 Each Session will be approximately 60 minutes unless the Client has purchased a Programme with a different Session length.

3.5 Speaking Voices will take reasonable steps to ensure that Sessions are delivered as agreed. However, Speaking Voices will not be responsible for temporary interruptions or delays caused by circumstances outside its reasonable control, including internet connection issues, third-party platform failures or technical difficulties.

3.6 The content of each Session will be tailored to the Client's individual needs and may vary depending on the Client's experience, objectives and upcoming auditions.

3.7 Speaking Voices and the Acting Coach will provide coaching, guidance and feedback with reasonable skill and care. However, Speaking Voices does not guarantee that the Client will be accepted into a drama school, pass an audition, secure representation, obtain an acting role or achieve any particular outcome as a result of the Services.

4. Booking and Payment

4.1 All Programme fees and Session fees must be paid to Speaking Voices which can be done via our online booking system.

4.2 In the event that the Client cannot pay online, the Client must pay the monies
owed to the payment details provided by Speaking Voices.

4.3 Another payment option is full payment by bank transfer. The Client must pay the amount owed to the following bank account:

4.4 Your booking will only be confirmed once payment has been received, unless otherwise agreed by Speaking Voices.

4.5 Where the Client purchases a Service or Programme online or by phone, the Client has a legal right to cancel the purchase within 14 days of the date of purchase and receive a full refund, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("the Cancellation Period").

4.6 If the Client wishes to exercise this right, they must notify Speaking Voices in writing by email to hello@speakingvoices.com within the Cancellation Period, clearly stating their intention to cancel.

4.7 If the Client wants their first Session to take place within the Cancellation Period, they acknowledge that, once a Session has been delivered, they will lose the right to a refund in respect of that Programme.

4.8 If the Client decides to quit the Programme or changes their mind after the Cancellation Period has ended, no monies will be returned.

4.9 The Programme period begins on the date payment is received, regardless of when the Client books their first Session.

4.10 The Client must book their first Session within two weeks of purchasing the Programme.

4.11 The Client must use all Sessions included within their Programme within the following periods:

  • 1 Session Programme: within 1 month of purchase
  • 2 Session Programme: within 2 months of purchase
  • 6 Session Programme: within 3 months of purchase

5. Rearranging Sessions, Missed Sessions And Cancellations

5.1 If a Client wishes to cancel or rearrange a Session online or face to face, 48 hours need to be given in advance.

5.2 If the Client cancels within 48 hours, then the Session will be deducted and the Client will lose that Session that they have paid for and booked; unless it is an unforeseen circumstance and is agreed with the Acting Coach otherwise.

5.3 No adjustments shall be made for time lost because of late arrival by the Client.

5.4 If the Client is late for a scheduled Session, the Acting Coach may contact the Client to check whether they are still attending the Session.

5.5 If the Client has not joined the Session within 15 minutes of the scheduled start time, the Acting Coach may end the Session and leave the call. The Session may be treated as missed and the Acting Coach will not be required to provide the remaining time at a later date.

5.6 If the Acting Coach needs to cancel or is unable to attend a scheduled Session due to illness or unforeseen circumstances, Speaking Voices or the Acting Coach will notify the Client as soon as reasonably practicable and arrange an alternative date and time at the next mutually convenient opportunity.
5.7 If the Acting Coach is unavailable for a continuous period of two weeks or more, the Client's applicable Programme period will be extended by the same length of time as the Acting Coach's unavailability.

6. Materials

6.1 All materials given to the Client are for educational purposes and are not to be redistributed.

6.2 Any scripts or other materials provided to the Client that are subject to a confidentiality agreement or NDA will be kept confidential and will not be shared or distributed without permission.

7. Client Disclaimer

7.1 The Services are intended for coaching, educational and developmental purposes only and are not a substitute for medical, psychological or mental health care. Speaking Voices does not provide diagnosis or treatment for medical or mental health conditions.

7.2 The Services do not provide a formal qualification or certification and are not intended to constitute regulated professional training.

7.3 The Client acknowledges that online Sessions rely on third-party technology and internet connections, which may occasionally experience technical or security issues outside Speaking Voices' control.

7.4 The Client is responsible for applying the guidance provided during Sessions and for making their own decisions regarding their acting development, auditions and career.

7.5 Speaking Voices may provide suggested exercises, activities or homework for the Client to complete between Sessions. While completion of these activities is optional, the Client acknowledges that engaging with them is encouraged and may support their progress, development and achievement of the objectives of the Programme.

8. Discounts

8.1 Discounts may be offered to eligible Clients through email, social media, promotional campaigns or other channels at Speaking Voices' discretion.

8.2 Discounts are subject to the terms and expiry dates stated in the relevant promotion.

8.3 Unless otherwise stated, only one promotional code may be used per purchase.

8.4 Promotional codes must be entered at the time of booking and cannot be applied retrospectively.

8.5 Speaking Voices reserves the right to withdraw or amend promotional offers at any time before purchase.

9. Data Protection and Confidentiality

9.1 Speaking Voices will handle the Client's personal information in accordance with applicable data protection legislation and Speaking Voices' Privacy Policy.

9.2 Information shared by the Client during Sessions will be treated as confidential, except where disclosure is required by law, necessary to protect someone's safety or wellbeing, or otherwise permitted under the Privacy Policy.

9.3 Speaking Voices will take reasonable measures to protect the Client's personal information and will only share it with third parties where necessary to provide the Services, where required by law, or as otherwise explained in the Privacy Policy.

9.4 The Client's personal information will be retained only for as long as necessary for the purposes for which it is processed, subject to any applicable legal or regulatory requirements.

10. Recordings and Media

10.1 The Acting Coach may audio record Sessions using a voice recording application for coaching development, quality assurance and service improvement. These audio recordings are for internal use only and will not be routinely shared with the Client.

10.2 Audio recordings will be stored securely and access will be limited to the Acting Coach and any authorised persons who may reasonably require access for administration, storage or service-related purposes.

10.3 Audio recordings will be retained for up to 30 days after the end of the Client's last Session and will then be deleted, unless a longer retention period is reasonably necessary to deal with a complaint, legal claim or safeguarding matter.

10.4 If the Client purchases the Playback Vault, Sessions will be video recorded using Zoom and the Client will be provided with access to the recordings via a private link as a learning resource.

10.5 The Playback Vault is an optional add-on and will only be provided where the Client has purchased the add-on and provided the required consent to video recording.

10.6 The Client may withdraw their consent to video recording at any time. If consent is withdrawn, future Sessions will not be video recorded. This will not affect any recordings made before consent was withdrawn.

10.7 Playback Vault recordings will remain available for 30 days after the end of the Programme, after which they will be deleted, unless the Client requests earlier deletion.

10.8 Speaking Voices does not guarantee that every Session will be successfully recorded. Where a technical issue prevents a video recording from being made available, Speaking Voices will, where reasonably possible, provide an alternative recording or other reasonable alternative.

10.9 If the Client is under the age of 18, their parent or legal guardian must provide written consent to recording before the first Session in which recording will take place.

11. Professional Standards and Safeguarding

11.1 Speaking Voices is committed to providing the Services in a professional, respectful and supportive manner. We expect the Client to uphold the same standards of professionalism, respect and appropriate conduct throughout the Services.

11.2 Speaking Voices expects all Acting Coaches to maintain appropriate professional boundaries and provide constructive and respectful feedback. The Client is expected to maintain appropriate boundaries and treat the Acting Coach with respect at all times.

11.3 Where Services are provided to Clients under the age of 18, Speaking Voices will take appropriate safeguarding measures. Any concerns regarding the conduct, safety or wellbeing of a Client or Acting Coach should be reported to Speaking Voices at hello@speakingvoices.com as soon as reasonably possible.

12. Complaints

12.1 If the Client is unhappy with any aspect of the Services, they should raise this with Speaking Voices in writing at hello@speakingvoices.com within 14 days of the Session or issue in question.

12.2 Speaking Voices will acknowledge the complaint within 2 business days and aim to provide a full response within 10 business days.

12.3 If a complaint cannot be resolved directly between the parties, either party may refer the matter to the courts of England and Wales in accordance with clause 13 below.

13. Law

13.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

13.2 Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation (including non-contractual disputes or claims).
